The "Zeitschrift für öffentliches Recht" (ZöR) has been the forum for academic discussion of important issues of public law at state, interstate and supranational level for over 100 years. The ZöR sees itself as an important organ of legal discussion in Europe and beyond, anchored in the German-speaking world. In addition to Austrian and German public law, international law including WTO law, European law and legal theory are the main topics of the journal. Legislative developments in the various European legal cultures are given special consideration.

Aims and scope

Even at the time of its founding in 1914, the ZöR was orientated towards the "interests of theory" and the "needs of practice". The three sections of the journal based on this - treatises, case law and practice reports and book reviews - formed its basic structure back then and still do today.

It has always been a hallmark of the ZöR that it offers space for fundamental legal analyses. It focuses on the foundations of everyday legal work and deals with legal issues "from the bottom up".

In terms of content, the ZöR was originally dedicated to the cultivation of Austrian constitutional and administrative law, ecclesiastical and international law and the history of Austrian constitutional law. However, this did not refer exclusively to the law in force in the territory of present-day Austria, but to that of the monarchy that still existed at the time. From the very beginning, the ZöR was therefore a publication that dared to look beyond the borders and wanted to comprehensively present and document phenomena and developments in the field of public law.

This basic approach was consistently developed over the following decades, so that today the ZöR sees itself as a forum for the academic discussion of important issues of public law at state, interstate and supranational level.

History

The "Zeitschrift für öffentliches Recht" was founded in 1914 by Edmund Bernatzik, Max Hussarek, Heinrich Lammasch and Adolf Menzel at the suggestion of Hans Kelsen, who also acted as editor of the journal for many years. The original title was "Österreichische Zeitschrift für öffentliches Recht", which was changed to "Zeitschrift für öffentliches Recht" at the beginning of the Republic. In 1948, the journal began to appear again under its original title, which was expanded to "Österreichische Zeitschrift für öffentliches Recht und Völkerrecht" in 1977 at the suggestion of Alfred Verdross. The increasing internationality was taken into account with the subtitle "Austrian Journal of Public and International Law". It was not until 1980 that Alfred Verdross, who had already co-edited the journal together with Hans Kelsen, ended his work as editor, in which Karl Zemanek had supported him for many years. Ignaz Seidl-Hohenveldern managed the journal from 1981 to 1990. From 1991 to 1995, the journal was published under the former subtitle "Austrian Journal of Public and International Law", mainly in English, edited by Christoph Schreuer. Since 1996, the journal has been published again under its traditional name "Zeitschrift für öffentliches Recht", until 2009 under the editorship of Heinz Schäffer, from 2009 to 2019 under that of Stefan Griller and Benjamin Kneihs. In 2014, the ZöR celebrated its 100th anniversary with a special issue (4/2014). In 2020, the editorship was handed over to András Jakab and Sebastian Schmid.

Procedure up to the imprimatur (print edition)

Your submitted manuscript will be reviewed by the editorial team. To ensure quality, articles undergo a peer review process before they are published in the journal.

If your manuscript is accepted, the publisher will create a galley proof of your article. This galley roughly corresponds to the layout in the journal. You will receive it by e-mail as a PDF file with the option of final correction and approval.

Book review format template

To ensure and improve quality, articles must undergo a peer review process before they are published in the ZöR. The main steps of this process are as follows:
Submitted articles that do not correspond to the content orientation of the ZöR or obviously do not fulfil the quality requirements are rejected by the editors. Contributions that are potentially suitable for publication are forwarded anonymously to a subject-specific reviewer. The editors select the reviewer.
The purpose of the review is to improve the quality of an article by identifying potential improvements of all kinds (content, topicality, language, etc.) and minimising any weaknesses. It is based on a standardised questionnaire that serves as a grid for assessing various aspects of the article (e.g. choice of topic, method, elaboration of arguments).
The final decision on the inclusion of a contribution in the ZöR is made once the review has been completed. In the event of acceptance, the author has the option of accepting the suggestions or - with justification - refraining from doing so.

The ZöR is committed to the standards of good scientific practice as set out by the Austrian Agency for Research Integrity in the "Guidelines for Good Scientific Practice". To guarantee that these standards are adhered to, all persons involved in the publication process undertake to comply with the following guidelines.

Duties of the editors

The editors are responsible for deciding which articles are included in the peer review process and which articles are published in the ZöR. These decisions are based on the scientific quality of the work and the recommendation of the reviewer. Manuscripts are assessed objectively based on professional criteria. Aspects such as the gender, origin, political or religious views of the authors are irrelevant for the evaluation.

Manuscripts will be treated confidentially by the editors. Information about the manuscript will only be passed on if this is necessary as part of the peer review process.

Duties of the reviewers

The reviewers are responsible for assessing the quality of the content of submitted manuscripts and thus supporting the editors in their publication decisions. This evaluation may only be based on the strengths and weaknesses of the text. Criticism should be expressed in an objective manner and supported by arguments. Any personal criticism of the authors of the manuscript should be avoided.

If the reviewer recognises that the work cannot be carried out completely impartially, the editors must be informed immediately.

Information about the manuscript must be treated confidentially by the reviewer and may only be passed on as part of the peer review process until publication. Information or ideas obtained during this activity may not be used for personal gain.

Obligations of the authors

Authors must guarantee that they have written the manuscripts and must clearly and recognisably identify any ideas and thoughts of others. Any co-authors who have contributed significantly to the preparation of the manuscript must be identified.

A manuscript submitted to the ZöR must be unpublished and must not have already been submitted to another publication medium.

Authors agree to accept the objective and factual criticism expressed during the review process and to respond to it accordingly.
